Court Strikes Out Omoaje’s Suit Seeking INEC Recognition
Abuja, November 12, 2025 — The Federal High Court sitting in Abuja has once again reaffirmed Chief Barr. Kenneth Udeze as the authentic, legitimate, and subsisting National Chairman of the Action Alliance (AA) political party.
Presided over by Hon. Justice O. A. Egwuatu, the court on Wednesday struck out Suit No: FHC/KB/CS/8/2024, filed by Mr. Adekunle Rufai Omoaje in which he sought an order compelling the Independent National Electoral Commission (INEC) to publish his name as the National Chairman of Action Alliance (AA) on its official website.
The suit was struck out following an application by Mr. Omoaje’s counsel seeking to discontinue the matter.
The ruling has several key implications for the leadership of Action Alliance (AA):
Mr. Adekunle Rufai Omoaje has withdrawn his request for INEC to recognize or publish his name as the National Chairman of AA.
Chief Barr. Kenneth Udeze remains the duly recognized National Chairman of Action Alliance, as reflected on the INEC website alongside his National Executive Committee (NEC).
The purported October 7, 2023 National Convention of the party, reportedly held in Abeokuta, Ogun State, has been declared non-existent, in line with multiple previous court judgments that declined recognition of that event.
The Independent National Electoral Commission (INEC) is, therefore, urged to continue recognizing the Kenneth Udeze-led National Executive Committee as the authentic, valid, and subsisting leadership of Action Alliance (AA), in compliance with several subsisting court decisions affirming same.
The Action Alliance (AA) expressed satisfaction with the judgment, describing it as another victory for truth, justice, and the rule of law.
